My phone I have right now is not working very well and I was wondering how I would get a new phone on the same plain I have right now in stead of the 2-yr contracts

If you want to get a phone without a contract you have basically 3 options. 1) Buy full retail 2) buy a Certified Pre-owned phone through customer service, or 3) Get something from a 3rd party. Now #1 is the only guaranteed option that will get you a brand new phone.
