I just upgraded it? Its a spare phone but its busted up (software issues) The phone is off the account but its still under its 1year warranty. can i get VZW to exchange it?

I doubt it, but you could always call tech support to find out.
Once off the account, you can not exchange through VZW, but you may going directly to the manufacturer.
