Using another family members upgrade?

This has probably been asked a billion times, so sorry about that. My mother and I both have an iphone 4s, but she has had hers for longer so she is eligible for an upgrade sooner than me. Mine is cracked pretty badly, and I can't use this phone for another year. Can I use her upgrade to get an iPhone 5?

Yes, but she will lose her unlimited data plan if she has one. If she wants to keep unlimited data, you should just pay full retail price for a new phone.

If there is no insurance, I am happy to inform you that yes, if your mother's phone line is eligible to upgrade, you may process an alternate upgrade by using her upgrade to get a new phone at discounted pricing then activate the phone on your line. This will extend her contract end date as well as her upgrade date. Also, please keep in mind, if she has a grandfathered unlimited data plan, it would remove her data plan and require to change to new data pricing.
