FIRST, know that I am an attorney.
SECOND, Know that it is a Federal Offense for telemarketers to robo-call a mobile phone, (without permission or invite to solicit). The minimum offense is $500 per call, up to $50,000 in some cases.
THIRD, I am pissed off by these annoying calls, and I want to sue -- the only way to stop these telemarketers.
FOURTH, I am betting that a lot of Verizon's customers would like to join me, and I openly invite them to do so.
FIFTH, the biggest obstacle to these suits lies in identifying the callers.
SIXTH, Verizon and Verizon alone has the information we -- Verizon customers -- would need to begin truly identifying these callers. Such information would include switching and routing information.
MY QUESTION IS THIS: What do you need from me, Verizon, to reveal ALL the information you have -- including not only manifest information, but latent information discernible through data available -- on the telemarketers who are calling me? I will give you information such as my phone number, the date and time of the call, and any additional information such as the telephone number my phone displayed that the call was made from. Is this something you will give to us, your customers, by our simple request? Or will you require a subpoena deuces tecum once a federal lawsuit is filed against, say, Does 1-1000?
I AM WILLING TO BET, VERIZON, that if you are willing to cooperate with us on this, INCLUDING potential causes for writ of mandamus against FCC, etc., then you can boast a network with the fewest telemarketing nuisances.
FINALLY, if you are a customer who is frustrated by these telemarketing calls, and you support the effort to sue telemarketers -- or better yet, if you are willing to join in such a suit -- then please reply to this discussion in any way you see fit -- to show Verizon that we are fed up with these telemarketers, and that we ask for their help in identifying them. A simple reply of "SUE TELEMARKETERS!" will suffice, with as much or as little commentary you want to provide. Let's fill up the replies on this board!
