This really is the culmination of a long standing battle over intellectual property and software.  Essentially from what I understand of this it boils down to software is basically copyrighted not patented.  So making derivative works doesn't violate the laws and making programs that alter the way it works doesn't violate any rights.  It has nothing to do with whether the phone companies have to accept it, how it affects Terms of Service, or how it will affect Warranties.  All it says is you can't be sued or put in jail for creating a rooting software or a software that gives a device a function it is capable of doing but has been blocked. 

 

 

This isn't Congress by the way it is the Library of Congress which is the governing body for intellectual property licenses.  I don't know if this settles the copyright vs patent question for software but the way they are treating it seems like it makes the question essentially moot.  Who cares what you call it here is how we say these are to be protected and what isn't protectable. 

 

 

Good to see the LOC is a fan of openness.  I dig it.
