I am currently going through a divorce and my wife has gotten another phone. If she gives me her old phone (the one on my account) that she has left data on, can I legally search it for evidence in the divorce? If so, what things am I able to look through?
Why would you think that you wouldn't be able to look through it its yours and use it as evidence specially when she hands you the phone what kind of evidence would you be looking for like text messages or pictures
Both, and any information about spending that might lean in my favor. Any other devious behaviors that might be found. There are many things that could sway a judges decision where I live. Spending being a big one since she's added me as an "authorised user" on some of her credit cards. >$10k credit debt in her name associated with me.
