Well, I'm glad I amuse you. Fortunately I make a pretty nice living raising hell with telecommunications companies.

 

I understand what you are saying about waiting, but waiting 6-8 months of my nine-month contract to get an update, or not, isn't acceptable to me. And yes, you're right. Soon 2.2 will be out and people will be complaining about that, because, if they are lucky, they will have just got 2.1... 6-8 months late. Personally I will not use the leaked image as I have read all about the bugs and missing features, one of the biggest being that copy-protected apps will not be available from the market, making one of my main reasons for wanting 2.1 moot.

 

In a perfect world, what I would like to see are software updates done more like the iPhone. Nobody gets it until everyone can get it. This way you don't have to worry about the whole world moving on to 2.1 while you're stuck on 1.5. I understand this may not be feasible with the fragmented market that Android lives in, but some attempt needs to be made to get CLOSE to that.

 

A more reasonable goal would be for the VZW software engineers to share what they are running into with the approval process. It is an open-source OS, afterall, and doing this wouldn't be completely unheard of.

 

My goal in "making a stink" isn't necessarily to get VZW to say, "Oh, you want this? Why didn't you say so? We've had it ready for months but were just sitting on it waiting for someone to ask. Here you go!" I'm not that gullible. In my view, I see three acceptable outcomes:

 

1) Give me some info. Let your customers in on the process a little. Let them understand what is taking so long.

2) Let me out of my contract without an early termination fee.

3) Allow me to get an Incredible for the 2-year contract price and use my Eris as a trade-in.

 

The first option costs them nothing but a little pride. The second doesn't cost them either, but does void any future revenue from me personally. The third is never going to happen.

 

Quite frankly I'm surprised at your defeatest attitude that I should simply accept that I signed a contract, and VZW will give it to me when they are good and ready, if they feel like it, like it is some kind of gift. If this was a regular cellphone I'd agree, but this is a smartphone that if not updated in a reasonably timely fashion, will be out of date before I really even started using it, and that is not something I'm willing to sit idlely by and tolerate.

 

The actual truth of the matter is that the VZW contract doesn't state any of VZW's obligations to you, the customer outside of service availability, but that does not obsolve them of all other responsibility. In fact, one could argue that allowing the software to lag behind means that the services provided by that phone are no longer available or severely limited.

First and foremost, you can't put the words "Ethical" and "obligation" in the same sentence without pausing to say "Uh, does that sound right?" You signed a contract with a Verizon stating that you'll be using the phone that you have in the condition that it was given at the time of purchase. Not for them to be "ethically obliged" to give you an update.

 

Your complaints about the OS are valid, thus, creating a good point; Most users who are still on 1.5 are starting to feel obsolete. We get it.

 

Unfortunately though that's not even close enough of a reason as to have Verizon release you from your contract. T-Mobile probably would have allowed you to, Sprint probably could have payed you to stay another week or so, and you may have had to grapple with AT&T a little to leave, but welcome to Verizon Wireless -- Where they're just as stubborn as you are.

 

The fact is there is nothing you can do about it now. HTC has the 2.1 code and is working on it (or probably already has, I forget) to be released to Verizon. Then Verizon tests it to then give it to us. If the stock UI took forever for 2.1 to come out, how to you expect a phone that is not only not as good as the Droid, but has a UI that is so complex it could make your head spin, to be tested and released with no bugs whatsoever?

 

I thought as much.

 

Welcome to the world of Phones, and in this case, the city of Android. Where one day you're in and the next you're out (Did I really just quote something from some cliche fashion show?).

 

And before you think it: Yes I'm a Moto Droid user telling you to live with it.

Sorry, I heavily edited my comment. However, I don't agree that lagging behind on software updates, an act that severely limits the useability of the phone, is not something that VZW could be held liable for. Not only that, but sometimes wireless carriers will let you out of your contract simply because they are sick of hearing from you, just FYI.

Being behind on software doesn't limit the phone. You should say that when you try to open Gmail and it says "Sorry, this service is only for users who are on the update 2.0 and above. Please call your local phone provider for more information."

 

And I don't know how long you've been with Verizon but I urge you to try and see how far you get. You and the kids who complain about the $9.99 data package might share a similar outcome (hint: they aren't going to let you out of your contract.).

See the other thread. I'm tired of bouncing back and forth. When the primary add campaign is "Droid does apps", except that yours no longer does, I think it's reason to complain. Come on, I'm starting to think you guys are covert VZW Ops. Why would you have a problem with me at least trying to have my voice heard on the subject before I move on?!

I see where the frustration comes from but there is one thing that has been repeated many times in this thread: "You take the device as is when you sign the contract with Verizon".  The big thing that people are missing here is that unless your contract that you signed says something to the effect of:  "This contract is legal and binding and includes a guarantee to upgrade your software by 4/28/10.  If date is not met, you retain the right to terminate this contract at your discretion", you don't have any leg to stand on.  I do know that somewhere in the contract I signed it told me that Verizon reserves the right to change services at any time without reason. Hate to say it but getting the OS upgrade is a service that can be changed. 

 

I still think the update is coming but it will just take patience.  I am a former BlackBerry owner and totally appreciate them testing software before releasing it.  Nothing makes you feel better than finally getting that upgrade to your phone that you wanted and then finding out there is a glitch that wasn't caught and the one thing you use the most isn't there any more.  :smileywink:

Kinda of a bummer for you that you cant wait for the update . You make a living out of raising hell? LOL these people are getting payed to hear us, you think they care if we raise hell, heaven or whatever? I think they are making a living out of us which makes more sense.(no flaming intended) the bottom line is that you have to wait for your update, no matter how bad you want it. I guess its a big difference going from the 1.5? 1.6 whatever it has? to the 2.1 On my moto droid, i didnt see much difference from 2.0.1 to 2.1. There is a leak somewhere online for the 2.1 for the eris, I dont know why a manager would suggest that tho, doesnt it void the warranty if you brick it?
