Phones are always changing.  As soon as the Incrediable is out for a few months, something even better will come along.  That is just the name of the game.  I have gotten burnt on this twice already the last two phones I have gotten.

 

You always have the choice to get a new phone, by paying full price if you are outside of your upgrade time period.  Cell phone companies already are losing money on every device they left you get at  disscounted price.  I doubt they will ever seriously consider letting you do this twice so soon. 

 

Hopefully you will get an update.  But it's a combo effort between Google/HTC/Verizon.  HTC has to get the 2.X code from Google, and develop it around the hardware and test.  Then Verizion has to do their own tests within their network.  Its a long process I am sure.  If they had a public beta that might make some people more happy, but if there were serious bugs people would be still complaining.

 

I got burnt twice before on the Windows Mobile side with updates.

 

Got a Palm 700wx with Windows Mobile 5, 4 months later Windows Mobile 6 comes out...I do not get an upgrade at all.  Asked Palm about a possible update, and they suggested I get one of their new phones with the Palm OS on it.  Stuck with 5 for the next 2 years.

 

Upgraded (still and Alltel customer at this point) to a HTC Touch Pro with Windows Moble 6.1 with a promise it would be allowed to upgrade to 6.5.  Then, the news of the Verizon/Alltel buyout surfaces, and no more upgrades for any Alltel devices.  It stinks sometimes, but cell phones change so fast.

 

People on other carriers are having the same issue.  My friend has a Samsung Moment on Sprint, and he is still at 1.5.

You my friend are misinformed, Verizon and HTC are obligated to provide us with some sort of update to a newer version of Android since many of us were promised an update by Verizon sales representatives and bought the phone on the pretext that we would be provided with said update.  Should Verizon and HTC fail to do so, I will be the first to start a class action lawsuit against them for false advertisement?

HTC is the same company that makes my Touch Pro.  Do I have Windows Mobile 6.5?  nope.  I am still on 6.1.

Is he really misinformed or do you have a dilusional sense of the law?  Did you sign a contract with Verizon stating that they would be upgrading the Eris to 2.X?  No.  You purchased a phone that has 1.5 with the "promise" from some low-level employee (and yes, even store managers are low-level compared to upper management) that they would be updating to 2.X in the near future.  I've got news for you, promises don't hold up in court.  Do you really think that the peon salesman you spoke to actually had real insider knowledge of when Android 2.X would be release?  Come on, use your head.

 

Besides, (and this is where the dilusional part comes in) do you really think a judge is going to allow a class action lawsuit just because you were "promised" a minor upgrade to your phone?

 

Just so you don't go off thinking that I don't care either, I also have an Eris and I also was "promised" 2.X in the near future.  I am a tech geek also.  I worked at Best Buy for 4 years and at the time had all the latest and greatest stuff, but you don't hear me making empty threats about class action lawsuits for something as trivial as this.

 

Bottom line -   Your phone works!  Get over it!

I'm using Co-Pilot live for my GPS software and it works great so I'm not in a hurry for 2.1    Once slingbox comes out for Android if it requires higher than 1.5 I will be in a big hurry to update.

Slingbox is pretty sweet!  I am thinking of getting one.  You have cable, Dish Network, or Direct TV?  Does it really work as well as it says it does?  I don't know anybody personally who has one yet.  I keep thinking about getting on.  I have dish network.

This isn't a phone where the lack of a software update can allow us to continue functioning as normal. As we speak there are apps that are being uploaded to the Market that cannot be installed on anything lower than 2.0. Not only that, sales reps advising customers that they will receive an update for this phone is not an isolated incident, and as such I do think that Verizon has an obligation to provide the update; maybe not legally, but certainly ethically.

 

If they do not update the Eris, pretty soon you won't be able to install any of the new apps that come along. It is for this reason that yes, Verizon Wireless does need to give us the update. I am not going to stand by while a phone I purchased only 4 months ago turns into a relic before it is a year old.

The G1 was three months old before it turned into a relic.

The MyTouch was four months old before it turned into a relic.

The HTC Hero was two months old before it turned into a relic.

Good gawd child where have you been? This is technology in it's finest essence. This is the phone market. Your phone is not useless, as the last time I checked you were able to make calls, browse the web, listen to music and a plethora more.

 

Besides, if your problem is the way that apps are updated for only 2.0/2.1 or higher, cry to the developers. Hint: They are the ones that make the apps.

Well, Mike, when you're right, you're right. I should just sit back and take it. My phone makes calls, browses the web, listens to music, and an ever-shortening list of a plethora more, at a whopping four months old. The last thing I should do is try to get some answers.

 

It isn't like I don't see your point, but forgive me if I find it hard to take advice from someone who isn't affected by the problem in the first place. What I'm talking about is a software update that I was assured I would receive within the same month of purchase. If the sales rep had said he had no clue when an update would come out, I would have bought the Moto Droid. The guy made it sound like the update was in the bag, and I intend to take VZW to task for that before I give up and live with it.

 

Maybe it was ignorant of me to think that rep had the slightest clue what he was talking about, but the fact of the matter is that he and hundreds more sales reps across the country sold the Eris on this very premise. The software would have to be an absolute wreck to take this long to correct, and good consumers need to let companies know when they feel ripped off.

 

I fully expect a better device to come out the day after I buy whatever I buy, but I was made to feel that I had bought a 2.1 phone, it was just a matter of weeks. That isn't what I got. I'm not quitting until I fill at least one important person's voicemail.
