This could be considered insurance fraud. When you file an insurance claim, your old phone becomes the property of the insurance company. You, however "sold" the phone to a kiosk. IF the insurance company finds out, you would be liable for the full retail cost of the replacement device and possible criminal charges.
You CANNOT sell a phone to another person OR a kiosk and then file an insurance claim on the device.
