frustrating iPhone 4s battery problem

I bought new iPhone 4s yesterday (I know, 5 looks nice, but 4s was cheaper!) and I'm having a really frustrating problem with the battery (and no, this isn't complaint about short battery life). The story is quite long, but I'm writing it all down to give a full picture, so I would really appreciate if you would bear with me.

The first day I brought it home (which was yesterday afternoon), I immediately tried to charge it full, but it got stuck at 70% for ~20 minutes, then suddenly jumped to 100% (according to both native iPhone battery indicator and 3rd party app). I have iPod touch and have used other iPhones in the past, so I knew that this was an abnormal behavior.

So I took it to the Verizon Store where I bought it, and they refused to take my words for it, and did diagnostics. First, they updated mine to iOS 6 (it was 5.1.1 out of box), and then charged it in store. It went from 46% to 78% alright, so I thought that the problem was solved.

Took it home again, tried to charge it. Again, it stopped at 85% this time, stuck there for few minutes, then jumped to 100%.

Again, I took it to Verizon, and they AGAIN refused to exchange it for the new one even though I took the screen shots of this happening. They did hard reset, restored via iCloud, then did test call, and again it went fine as if there's no problem. I even insisted on charging it to 100% in store, and it charged well up to 95%, so again I was told that it was just a software glitch by Verizon reps, Verizon national tech service, AND Apple rep on the phone.

So here I was again, took it home, charged it to full 100% with no problem. I thought everything was fixed. But just now, the phone went from 95% to 75% AGAIN in the matter of few minutes! Furthermore, the 3rd party app is indicating different % from native iPhone battery app, which I was told by Verizon it was normal, but I don't think so.

I'm planning to take this iPhone 4s to Verizon for the 3rd time (in the matter of less than 2 days) and I am going to be really angry if they don't exchange it without all the ridiculous diagnostics. However, I was just wondering what anyone think of this. Do you think this is a software issue (iOS 6) or hardware/manufacturing issue? Not that it matters, this phone is unstable and I refuse to be stuck with it for 2 years, but I wanted to hear opinions about this. Thanks for any opinions, and thanks for reading this tl;dr post.

I have learned that Verizon is not helpful at all. I highly recommend going to an Apple store. They are so much more helpful and a lot nicer! Good Luck!

The reason why they can't exchange it...  It's out of stock, and there are no refurbished ones yet.  Your best bet as the above guy mentioned is going to a Apple Store, and hope they have something in stock.

They should have plenty of 4s. They do have Clnr of 4s. Mine stops when it gets hot it while charging so it takes longer to charge and i catch it sometimes showing a plug in the battery like its full but it says it isent full so i know it stops. Take a screen shot when you see any icon or anything that you think is important. Screen shot is like taking a picture of the screen. To do that press home and power together then release quickly. It will save in your photos. Not sure if they should have updated you since there's problems with ios6.

I second the recommendation to take your phone to an Apple store. Apple is very good about switching your phone out at no cost if there is a problem. You do not have have to buy your phone from them to do this. You are within the timeframe to do this even without applecare.

Edit....call the nearest Apple store to make an appointment. They are very quick to get you in. I personally would not deal with the carrier regarding iphone hardware issues. Also, while you are in the store with your phone, it would be a good idea to check into their applecare. If you did not purchase applecare at the time you bought the phone, you would be able to do so then. They just need to see your phone to be sure it is still in good condition...no broken screen, etc. Applecare would then cover issues for 2 years from the time you purchased your phone. Applecare and applecare plus is available for purchase.

I did take the screenshots of this happening, but they disregarded it as if it wasn't enough evidence that this is a defective phone.

I know that apple store has better service but the closest apple store is an hour away so it's inconvenient to go there.

I'm going to try verizon one more time this weekend and if they still refuse to exchange it, i am going to check out apple.

Thanks to everyone who replied. I'm just frustrated and stressed about all this. All i wanted was a functioning phone.
