The ETF is calculated based on the subsidized phone that you received when you upgraded, not the phone that's currently active on the line.

Is there a way to get out of an ETF?

You could have someone take over your line through an Assumption of Liability.  Otherwise, no .. you have to complete your contract or pay an ETF if you cancel early.

Of course not.  When you signed a 2-year contract and bought a smartphone, you got a $600 phone for $200 (approximate).  Verizon gave you a $400 discount and in return, you agreed to make 24 monthly payments.  You need to fulfill your obligation by remaining as a customer or paying the ETF of $350 less $10 for each month completed.
