So it's a way for me to be annoyed for which I have no control over it?

Maybe I should return to my original thoughts

when my series of problems began... round up all

the disenchanted customers (easy to find, they

post all over the web) and file a class action?

Basically applications like this isnt breaking any laws so I do not see the bases of the law suite but I can say that it can be a bit of a pain to deal with the notifications but officially the application or the message are classified as Spam because from what I have read the application has to be accessed to start the notifications process and I am sure that in the agreement to use the application it explains that the notifications will happen.  Not disregarding your feelings on this situation but pointing out another angle to consider.

Have you tried looking in the settings menu of the app and see if there is a option to disable the notifications?

It came installed on the phone. Force-feeding

you advertising is indeed spam. I'll run it by

my son-in-law, a deputy county attorney. If he

gives a thumbs up I'll bring up one of my attorneys... I only have three >:-}

Well you are free to proceed as you see fit but make sure that it is understood that the advertisment seems to be only a issue on a handfull of device and this is because the application that it is attached to has to be ran by the user and they have to agree to use the app..  

You may want to be sure that the agreement for using the application does not inform you of the advertisment because if it does your case wont have much to stand on.

I just looked over the post link I post for you earlier and found this....   Did you follow this to disable the app as it states?

How do I cancel Daily Scoop?

If you decide you don’t like receiving Daily Scoop, you can delete the software from your phone by going into the Get It Now® catalog and removing the software. Should you reconsider, you are welcome to re-enroll at anytime.

You can delete the application from your phone by following this procedure:

  • Select "Main Menu."
  • Then select the "Get It Now" menu.
  • Click "Tools on the Go."
  • Then select "Daily Scoop."
  • Choose "Options."
  • Select "Delete/Cancel."

I don't have a "Get It Now", just "APPS". But I

finally figured out which keystrokes were

required to get "NO" to stick (ignore the

directions and experiment and pray) O:-)

So I'm hopeful.

It drove me nuts during a day-long patent

deposition last Saturday. The only way I could

stop it was to turn-off the phone... it went

insane during that "Haboob" (here in Phoenix

=-O The lawyers were not happy, particularly

when I snapped at the opposition attorney (she

claimed to have an EE degree) that she was just too dumb to understand >:-}

Looks like from the manual that the "Get It Now" option is listed under the menu as the "Media Center" icon, do you see that under youy menu?

So I don't have a Get it Now. I have Daily Scoop listed under my Aps, but when I go to Options on it, there is no option for deleting or canceling!?

The option appears to be in a other area than in the actually application...  Everything appears to directing to a "Get It Now" option.
