8330 has no upgrade for the software yet. Should be around April

Thanks for the information everyone. You can use the steps below to check if there is an available software version update. If your receiving a message saying your device is unable to update, your phone may not have an update available at the time. 

Note: Before installing the BlackBerry® Device Software, make sure that the BlackBerry® Desktop Manager is not running.

To download the BlackBerry Device Software, complete the following steps:

1. Visit http://na.blackberry.com/eng/support/downloads/download_sites.jsp
2. Select the appropriate service provider.
3. Click Download BlackBerry Device and Desktop Software.
4. Complete the instructions on the screen
