Updates are rolled out in stages and, AFAIK, when the rollout is done, it's generally available to all phones. I've had to replace my Eris a couple times and, as soon as I start the phone, it shows an update is available. I may be wrong, but there are usually methods to get the update over the internet if you are comfortable with that. Doing a factory reset before upgrading is generally a good idea, as well as making sure your phone is fully charged before performing the upgrade.

If it says there is no update available try *228 option 2 and after it completes try again. Worked for me.
