Short answer, you can't. That's why they have the 14 day exchange period (not long enough IMO, but you know that going in). After that, you call CS, go through troubleshooting steps with them and, assuming that doesn't fix it, they send you a CLNR. Test out the hotspot right away, and call back if it doesn't work on the new device. After a few exchanges, you may be able to get a different device, though it will still be a CLNR.

Probably would be less hassle to just throw the phone away and pay $650 for another phone.

I've been quite content with mine.  Then again I'm not letting Verizon dictate my "experience".

I just took care of this nagging issue of reluctant updates yesterday from manufacturers on my Android tablets for good by selling the crap I had and ordering a Nexus Tablet. As tired as I am with the continual update nonsense from the Android OEMs/carriers, it wouldn't take a whole lot of prodding to go right back on the Play Store and clean up the phone side of things as well at this point because my patience has worn razor-thin with it all.

much like the galaxy Nexus... Some people problems were fixed, and some people weren't.  with updates it's always  a hit or miss.

You are (mostly) correct here. The update will include new radio software to fix some of the issues some are having. But, for whatever reason, problems persist beyond updates for some people. I have noticed, as well 😉 that connections and transfers from 3G to 4G are much faster.

judging from your wording, i'm going to guess the updated kernal and standard radio did more to improve your service than the 4.0 overlay

Yes, of course. They could have always released a radio update, completely independent of ICS, and the connection improvements would have been the same.
