Updating modem after many hours

So my kin two has been in the "updating modem do not remove the battery" screen for a day now and doesnt seem to be doing anything.  I took out the battery, tryed the sync and nothing has worked. I took it to the store and they said there was nothing they could do and only option is to get a new phone.

 

Does anyone know how to fix this? I think is **bleep** to have to pay for a new phone since we dont have insurance and they sold a defective piece of C%$p phone.

I am having the exact same problem.  It started last night while it was charging.
