I decided to send an email earlier today to Sergey Brin (co-founder of Google) asking for his input on this issue of the Revolution's OS and the constant failure of these phones (I also provided him the link to this forum so he can see how widespread this problem really is).

I followed this up with a formal letter (to be sent out tomorrow morning) to Verizon's CEO  Ivan Seidenberg informing him of the breach of warranty's listed below and that I expect to be offered another upgrade on both phones with renewed contract pricing because Verizon has violated the implied warranty of merchantability.

Not sure if either will respond, but it made the aspiring attorney in me feel better about the situation

Express warranty ((U.C.C. § 2-313)

Implied warranty of merchantability (U.C.C. § 2-314)

Per Consumer Reports (2012): "The law: The Uniform Commercial Code, fully adopted by most states, stipulates that most new consumer products come not only with an express warranty, but also with a so-called implied warranty of merchantability. That is an automatic, unwritten promise that your purchase will perform as commonly expected, including that it will last a reasonable amount of time given the nature of the item. In most states, implied warranties are in effect for four years, although that doesn't necessarily mean a product must last that long. Implied warranties apply to retailers and manufacturers and may be broader than an express warranty.

If you have a problem with a product that you think is the result of an inherent defect, let the manufacturer or retailer (preferably a supervisor) know that you'll take its failure to resolve your complaint as a breach of the implied warranty. If you don't get satisfaction, you may be able to assert your rights through a credit-card chargeback. If that doesn't work, send a letter threatening legal action. You might need to file a small-claims-court action or consult a lawyer" (Section 6).

Hello,

Verizon has just sent me a 4th LG Revolution phone in 8 months. The issues with each phone have all been related to power cycling on and off, which is a software issue that is beyond my control. I have spent numerous hours with each phone trying to trouble shoot with Verizon support via corporate store or call center. When the 3rd phone started having similar issues as the previous phones, I documented Verizon's resolution to the problem, which they send a certified refurbished phone as replacement, and submitted this to the Better Business Bureau. Being that my contract started 8 months ago, my options are limited. After talking with numerous Verizon support staff, I have gotten differing information.

What are my rights? Do you have any recommendations? What should I be documenting?

Take out your sd card

do a factory data reset

create a new gmail

run the phone for a week before you realize it isn't power cycling

Then figure out which app was causing the problem

Yea, already did those steps and never downloaded an app after factory data reset. On top of those steps, I have also powered down completely when the issue occurs. It has been over 9 days and still is power cycling sporadically, which puts stress on me making important calls, due to not knowing if the call is going to be dropped in relation to the phone turning off and on.

commonsense101 - I have NO DOWNLOADED APPS on my phone. They sent me a "like new" used phone which I downloaded no apps on and it continues to do the same things. I finally got fed up with this phone and went into the Verizon store. They are sending me the Droid Razr this time to replace my malfunctioning Revolution.

I was told by one of the employees that there may be an error with a pre-loaded app causing the phone to do the crazy thing it does. Not sure if I believe this, but it is what it is.

I did the same thing, I have had issues the last two months and the phone was GREAT (minus the inability to do a software update i needed but a replacement phone fixed that). So i had like 6 calls into the company within these two months until i got fed up and called in last night. Obviously there is something wrong here and i even direct EVERY person from VZW to google to see ALL these complaints yet they act like Nothing is wrong. What really needs to happen is a class action lawsuit on them for this since its evident we aren't making it up when you see pages and pages of google with this same issue( even on different phones)

My revo is a total piece too! I am so sick of this worthless piece of junk that I am stuck with unless I spend another $500.00 to upgrade, and vzw customer service always acts like not one other person in the world has had any of these problems- yeah right, just google it and look at the page after page of people with all kinds of issues with this rotten LG Revolutions. I'm just plain tired of calling them and not getting anywhere, and I'm tired of pulling the battery every other day because stupid thing has frozen. Have you had any reply or advise after writing to the bbb?

I had excellent luck with the BBB I got a full refund for my phone!

twoyorks IS 100% RIGHT!!! Get rid of that thing as fast as you can before the return time runs out, or you are going to be stuck with it for the next 2 years, BTW the replacement phones they'll send you are just as bad.This rotten phone should be recalled and removed from the market, just google the thing and read from all the other thousands of people who are stuck with it!
