How can Verizon legally BLOCK my wifi hotspot app?

My phone upgraged to jb. Have called Verizon several times. I went into the store. They said they did not block it. My phone clearly states it has been blocked by Verizon.

I paid for the app that was preloaded on my phone. The app was free at first then they started charging for it. I have unlimited data.

If Verizon has already been fined for doing this. Why are they allowed to do it again? Verizon Fined $1.25 Million for Blocking Android Tethering Apps ...

If you have a Verizon unlimited data plan, you must pay for tethering.  I have the unlimited tethering plan for $30 per month.  This is in addition to your unlimited data plan and in accordance with the FCC ruling.  You can also get 2GB for $20, I believe.

"GigaOm adds that Verizon also won't be able to charge customers on its tiered data plans the $20 a month tethering fee, though it can charge those customers who are still on its unlimited data plans."

If you got unlimited you still can get the $30/ month hotspot i did like month or so go.

They were fined for blocking apps from appearing on the app store.

True that in the July settlement the specific violation was Verizon preventing download but the FCC stated that the reason it was a violation was that Verizon, in purchasing the C - Block of spectrum from the US public, was obligated not to " not deny, limit, or restrict the ability of their customers to use the devices and applications of their choice on the licensee's C-block network,"

I imagine we'll soon see if this is just a bug and  tether applications for non-rooted devices simply need to be tweaked to work with JB or if Verizon has purposefully embedded software that stops them from working.

You don't get it Verizon is allowed to charge for those on old data plans. The FCC approved that in their settlement. If you want free tethering you need to be on a Share Everything plan.

You're partially right.  The grandfathered unlimited data plans, for obvious reasons, were excluded.  You don't want people providing unlimited data to their whole neighborhood.  This makes perfect sense.  All metered plans were included.

It's public information, so anyone who's interested can google it. The actual order and consent decree are available FCC.gov. A web forum hosted by the company might not be the best place to get unbiased information.
