Is there a way to import my texts messages from my old phone, they did not transfer over and i used the back up assistant on old phone before activating my new phone.

you may be able to if you have a text backup app on each phone
You can download an app from the Play Store called "SMS Backup & Restore". Backup the texts on your old phone and copy that file to your new phone. You can then restore the texts to your new phone.
You should be able to do all of this without re-activating your old phone by using WiFi.
