While I applaud the marketing staff's efforts to deny that slowing the speed of LTE customers is throttling, and that the lawyers have made a very loose interpretation of what is considered "reasonable network management" to dodge FCC Block C spectrum rules (reasonable would be slowing down the folks that are, at the time of tower congestion, using the most bandwidth, rather than punishing top 5% unlimited data users who may not be using much bandwidth at the time of congestion, but have done so in the past during said billing cycle) , I figure I should prepare for the worst, since I do enjoy watching HD Netflix while traveling.
Is there anyway to sign a new 2-year contract with Verizon such that my unlimited data plan will not get throttled? I don't want a new phone or upgrade, just a contract to ensure price stability, current plan, and no throttling.
Given I live in DC, there is plenty of congestion and I'm likely in the top 1% of data users given I push upwards of 40gb a month watching netflix (no TV, so phone gets it).

The reason for the charge when paying your bill is because it is a third party store. NOT owned by VZW but an independent person or company. Since VZW does not give these franchises the same billing system as they have in corporate stores. There is a third party company processing your payment to VZW and THEY charge the fee NOT VZW. However, there are other fee free ways to pay. They include online, on the app, over the phone as well as in a VZW corporate store. You can find a store locator on www.vzw.com and since you have unlimited data it shouldn't be a problem.
Now, you can't be mad if they decided that heavy data users such as yourself are not prioritized. Sure, you pay for unlimited but when you clog the network using 60GB of data it makes a less than desirable experience for users that consume only a fraction of that. Between my 5 lines we use about 9GB a month. I will be glad when VZW says no more unlimited under any circumstances.

Third party retailers have different policies. It probably does say Verizon Wireless on the sign, but right under is the third party retailer name.

Contracts are over. Also courts already ruled. Unlimited data is different from unlimited bandwidth. As long as you are not paying for data after the initial buy in you do have unlimited data.

This Verizon store is not Wal-Mart. Their Verizon Wireless sign is maybe 2 feet tall letters. The only thing they sell is VZW products & contracts. It may be a Franchise, but it's still a VZW store. Are u saying a franchise operated McDonald's isn't a McDonald's?

Mc Donald's controls the franchise, and the locations are all the same product.
Verizon Wireless gets partners to sell their products and services and the franchise is that stores parent. In example we have a Verizon Wireless Store which is "On Call" they have a huge sign saying Verizon wireless and the people would think it was a Verizon Wireless Corporate store. Alas they are not.
The franchise is "On Call" not a Franchise of Verizon.
The same is for Best Buy and walmarts or Costco or Radio Shack.
They may have a Verizon signage but you and I both know they are in no way a Verizon Wireless Franchise.
Its all in the wording. You should know that being a Police Officer.

Customers are being charged for data above and beyond a cap. They're still getting all the data they can consume. It just may be slower speeds according to the stress on the tower. Perfectly summed up. At this point an admin should come along and lock this discussion.
While I'm not opposed to an admin locking this thread over the cop tangent going on, it would seem that the FCC Chairman agrees that data usage and bandwidth are linked:

You know it's an election coming up right? Nothing will come of it. The supreme court trumps the FCC which presidence was set in multiple court cases. Bandwidth does not equal data. Even the dictionary does not have them synonymous with each other. A thesaurus as well. Even what they teach kids in school since the inception of the internet.
Also if the FCC didn't think they are separate then WHY the F didn't the FCC disapprove the terms and conditions that were presented to them for having the fair use clause? People forget that since the early 90s the FCC had to approve the carrier terms and conditions.
