How do I return a prepaid phone I bought from Verizon online

I bought a prepaid phone online from Verizon and got it Friday. I want to return it and the instructions are very confussing, seemed to be geared toward contract phone, not a prepaid.

My biggest complaint seems to be a noted a 35 buck restocking fee. Why do I have to pay that. First of all, I don't like the phone, it's poorly made and doesn't seem to work well.

I have a return label but I'm not going to be out 35 bucks for restocking. I'll file a complaint with the Better Business Bureau.

Please explain this to me, as I'm VERY unhappy with Verizon right now!

How Do I Accept my Prepaid Customer Agreement?

You accept the agreement by:

Agreeing in writing, by email, over the phone, or in person;

Opening a package that says you are accepting by opening it; or

Initializing your account.

When you accept, you're representing that you are at least 18 years old and are legally able to accept an agreement. If you're accepting for an organization, you're representing that you are authorized to bind that organization, and where the context requires, "you" means the organization.

If you don't want to accept, don't do any of these things. You can cancel your Prepaid service if you tell us (and return to us in good condition any wireless device and/or any card you got from us with your new service) within 14 days of the date of purchase with the original sales receipt. A restocking fee of $35 will apply to all wireless device returns (excluding Hawaii). No refunds will be granted or returns accepted after 14 days, if the card has been used, if the coating on the card has been scratched off, or if your account has been initialized.

Since the activation card is usually inside the prepaid phone box and the card must be scratched to use the code, and the code is used to activate service...and since you can't use the phone without service, you basically are stuck with the phone if you actually used the phone with service after having used the card and code.  The return is really only good for unused phone, card and service.  Using one pretty much nulls the rest.

So let me see if I understand this correctly, for a phone I paid 90 bucks for, you people keep 35 if I return it. and as for the month of prepaid service, I'm stuck with it!

Seems to me Verizon screwed me, at least for now. I just disputed the charge and filed a complaint with the Better Business Bureau!

When you say "you people ", I assume you mean Verizon, and you have not gotten any replies on this thread from a Verizon rep.  What Snn5 pointed out is the terms and conditions YOU had to accept in order to complete your order. If you didn't read them, you screwed yourself. The BBB isn't going to do much to help you fight a fee you agreed to.  And no, I DO NOT work for Verizon. Never have, never will.

I can't really explain it better than Flutterfly8497's explanation of my explanation.  Prepaid tends to be a permanent purchase, be it equipment (outside of the terms of refund and return), time, or funds.  Even if you stayed Prepaid, if you put money in the account, it stays.  There are no refunds for that either.  I don't work for Verizon, but I am a fellow prepaid customer.
