I recently switched from the Note II to the Note 3 and for some reason all of my contacts and apps ported over, but NONE of pictures and videos did. I have NEVER had this issue when switching devices...usually when I do the initial set up with my google account, EVERYTHING ports over. I've lost ~300 pictures and photos because of this. I'm not sure if it was because the SIM cards were switched or what. I no longer have my Note II and I never put the photos on cloud or my MicroSD card. I guess I'm screwed because I have no clue on how to recover those photos that was on my device...years worth of photos 😞

As said, unless you backed them up they are lost. As far as saving photos, music, videos on the SD card, they should automatically be put there after they are saved.
Unless you backed up the photos somewhere (recheck you google acct) they are lost unless you get you Note 2 and retreive them. How come you don't have your old phone?
It is always a good practice to put your photos and music on the sd card instead of internal memory.
Well I've never used my SD card (partly because I didn't know how to save there) or cloud, but I know the pics were saved on the hardware's internal memory. Every other device I've had (including the note 2) all my pics transferred over once I did the initial set up of the phone. This time it didn't. To top it off, I sold my phone on eBay and shipped it off. Verizon sort of screwed me with the device because they had me without a device for a couple days when I shipped my Note II off to it's new owner. SIGH

Contact the new owner and have him transfer the pictures to a sd card and send it back to you, or did you do a factory reset before sending it?

The internal photos are in a folder called DCIM the photos can be saved to external sources via hooking via USB and then going to said folder and doing a copy paste to a new folder you can create on your computer or on an microsd or sd card.
Under gallery there is an option to have photos by default save to the sd card. this way you will always have them.
The suggestion of getting hold of the buyer of your old device to assist you in getting them back is a good idea.
But if the phone has been wiped they are now gone. Sorry.

If anything is on the SD card, music, photos, etc., than a factory reset will not effect them. Only a formatting of the SD card will wipe it clean.

Thank you all for the help. I did do a factory reset on the original device before I shipped it off because I was under the assumption that the photos were linked to my google account for some reason since they always transferred over from my previous devices (2 of which were android). I guess I just have to accept that they are gone forever and not assume.
Have you tried any of the photo saving apps, such as Dropbox. For future saving of photos (and other stuff if you like), try one of them. I have Dropbox, and can share my photos with anyone I like. Sometimes it gets a little too saving, pictures I take as a test or something, Dropbox grabs it and saves it. There are other such apps. You might want to try one or two of them for future photos.
