The only way I can receive/download a picture text is to turn on the mobile data which uses up my data. Why is that? I had no problems on my old regular slide phone and I didn't get charged data. Should that go against my texting minutes?

Yes mobile data has to be turned on however sending or receiving MMS files does not use any data. It only counts against your texting plan.
