if this has been asked, which i'm sure it has, i'm sorry for asking it again. i have read a lot of the 11 pages of posts in this thread and i am still confused. so my question is, if i have a 4G HTC thunderbolt and i upgraded to a new phone, like the samsung galaxy s3, before the new plans are officially announced (if its released before the new plans are announced), will i be able to keep my unlimited? i've tried to research this online and i've seen answers for both sides.

Until they announce OFFICIALLY and roll it out, you will be able to keep your grandfathered unlimited data plan.

The announcement that Verizon made that stated this thread said that it was just on paper only. They are looking to kill the unlimited when they roll out the SHARED data plan. Until that is done, you can are grandfathered.

Yes,  unless they decide to drop it anyways. Verizon does what it wants when it wants no matter what you or I think. If they want your unlimited plan gone it will be gone. This is how it was told to be by someone last week over the phone from Verizon when I asked what guarantee I would get signing up for two more years.

GOD loves YOU and there is NOTHING you can do about it!

"I ask, why doesn't Verizon (or any major wireless carrier) offer smart phones without data plans?"

T-Mobile offers this service if you BYOD or pay full price to the carrier.

@Jimdandy,

VZW could certainly force anyone they want off of the unlimited data plan. Just remember, that would void any current contract and VZW would be losing on any phones they had subsidised.

It only voids the contract if the change has an adverse effect and in most people's case it probably wouldn't.  And still not sure Verizon would consider it adverse even for the others who would be subject to overages or have to change to a higher tier.

Can Verizon Wireless Change This Agreement or My Service?

We may change prices or any other term of your Service or this agreement at any time, but we'll provide notice first, including written notice if you have Postpay Service. If you use your Service after the change takes effect, that means you're accepting the change. If you're a Postpay customer and a change to your Plan or this agreement has a material adverse effect on you, you can cancel the line of Service that has been affected within 60 days of receiving the notice with no Early Termination Fee if we fail to negate the change after you notify us of your objection to it."

The contract is for voice service only (someone has already said this).  A data plan is required for smartphone use; however, it doesn't have to be an unlimited data plan.  As long as VZW still offers a data plan at the same or lower price than the unlimited data plan, VZW would not have to let anyone out of his/her contract.

I had an unlimited plan on 5 phones and called to ask that very question.  And on my next bill the unlimited plan had been changed without my approval on 2 of my phones.  That is the only thing that is wrong with Verizon some of their customer service agents don' listen well or understand.  And  I am now the one who lost out....

L2R the T&Cs ... from the webiste (under customer agreement at the bottom):

***Your Service terms and conditions are part of this agreement. Your Plan includes your monthly allowances and features, where you can use them (your "Coverage Area"), and their monthly and pay–per–use charges.***

That means that features like a data package are part of 'your plan.' Follow this by a paragraph a bit further down,

****We may change prices or any other term of your Service or this agreement at any time, but we'll provide notice first, including written notice if you have Postpay Service. If you use your Service after the change takes effect, that means you're accepting the change. If you're a Postpay customer and a change to your Plan or this agreement has a material adverse effect on you, you can cancel the line of Service that has been affected within 60 days of receiving the notice with no Early Termination Fee if we fail to negate the change after you notify us of your objection to it.****

This clearly states that if your plan (which includes any features) is changed and it negatively effects you that you can cancel within 60 days with no etf. The only things that this does not include would be taxes and promotions. I really don't know where this idea that the voice package is the only thing protected under the T&Cs came from.

True but contrary to popular belief, Verizon decides if it's adverse.  They'll likely credit you back a small amount and tell you to like it which is basically what they do anytime a fee changes.  It's certainly not an easy out like people want to believe.

They will certainly try to convince you to not fight it and basically keep the service for the 60 day time frame, but if you don't let that happen then they will have to back down. Worst case scenario they can pay for an arbitrator to tell them that the etf needs to be waived . For one of these changes to not be adverse they would need to make sure that the cost doesn't change... so if they force you to the $30 2gb plan they would have to issue credits every month for $.01 and for any overage.
