It seems like the phone companies have a pretty good racket going. They sell you Brand New phones and when you have numerous problems with them, their answer is to just send you a used re-conditioned phone. I just went thru this again after I bought two Galaxy 3's and had way too many problems with both of them. I specifically told my Verizon rep I bought two expensive phones that were suppose to be the best out there and I want them replaced with two brand new phones just like I bought and he assured me quote: ( You will receive two brand new phones because they are too new and they don't even have them re-conditioned yet) I received two re-conditioned phones! If you purchase a vehicle and you have numerous same problems with it, you can go after the manufacture under the lemon law. They will either replace it with a brand new vehicle of equal value or refund your money. I have already got the run around from Verizon. I have been a customer with this company since before it was Verizon and have spent thousands of dollars with them and am shown no loyality from the company. I didn't buy a used phones and don't want it replaced with a used phones! Since one of my family members is in the legal community,we are going to look into the consumer protection end of it. We are probably going to open a can of worms!!!!!!! I think it's a huge cover-up that nobody has opened up. I would like to hear how many others get the same run around from Verizon? By the way, all the phone companies seem to follow the same practice of screwing their customers so were not the only ones getting it.

Have you actually read your wireless contract and the terms and conditions of the warranty replacement service provided by Verizon Wireless or the paperwork associated with your phone insurance?

Yes we have read thru all of my paperwork. My family member is a contract litigator. The point is when a company representive as quoted states to me "You will receive a brand new product as replacement because they are too new and they don't even have them re-conditioned yet" As a business owner myself and one of my employees that are the face of my company gives his or her word, some times you have to eat it and make the customer happy. This just goes to show what happens when companies get too big and personal customer service is out the window! Unless you have owned a business yourself you won't relate.

If you are within 14days you can get a new phone replacement in a box. Not in 14days you get a phone not a in a box. How do you know it isent new just because it's not in a box. Your not promised a new anything especially assorian you can get a like device if they dont have any of yours. Your not the only one that has got a replacement. Aeast they didn't make you go to the apple store if it's an apple phone. If its not you would have been out a phone for 2 weeks. Assorion is the same way. Atleast you got a replacement. Vzw tells you the rules before you ok it. So is your replacement working? Be happy you got a phone.

It's in the insurance pamphlet at the vzw wireless store the info I'm talking about so you can have them read that. It's the warehouse who sends the phone to you not some phone person over the phone.

But it seems the highlighted statement had a condition which assumed they didn't have any re-conditioned GSIII units yet. He was obviously wrong. Still, good luck.

I also have SEVERAL lawyers in my family. They love to say "of course you can litigate ANYTHING, doesn't mean you have a case, though."

Their rep may have been wrong but it's up to good customer service to make it right. As far as litigating, that's what research is all about. I went thru this with a large corporation years back and they thought they were so big and had so much money and could out last the consumer in a case, in the end I won the case and happen to be an advocate now helping others go after the same company. These companies have gotten so big that they don't care about the customers anymore.

I believe the contract has wording that the contract is the complete and total agreement, and excludes all other communication. So, even if you have signed and witnessed proof of the representative statement (which I am guessing you don't!) that might not matter. Of course, you can litigate that this is unfair etc, but no guarantee of a win.

Also, "Word of mouth can make you or break you!" Generally not the case for big near-duopolies, rightly or wrongly. And for every post like yours, there are similar ones on AT&T/T-mobile/Sprint. Almost no-one loves their telecomm provider (too much money for too little). And yes, there are well-publicized consumer wins (Bank of America and Netflix) but people ignore all the losses.

If you are int he first 14 days of the new phone they will replace them with Brand New devices. Anything after 14 days and they will send a Refurbished device out. This is stated in their contracts and all of their materials.

Someone makes a good point on here about being a business owner and standing by what his reps tell people. unfortunately Verizon missed those etiquette classes and they do NOT recognize of stand by claims that their reps make unless it is in their own interest to do so ($$$$). Their supervisors will flat out tell you that the rep lied to you and they will be spoken to, but they will NOT stand by what the rep tells you even if it is in Writing. They do not subscribe to the notion that their reps can make agreements with customers and have them be binding.
