Actually if you look at how it's set up your wrong. If the minutes and texting were on the deice fee then why would an account with nothing but basic phones be required to get a data plan when basic phones are not required to have data plans? It CLEARLY states the minutes and texting are part of the data plan.

In at least one example, you both are wrong, for what it's worth.  Basic phones do not require data and an account with only basic phones does not have to have a data plan.  Remember there's also this option:
basic phone, $30
$10 "other" fee - can't really call it a 'data' fee since there is no data; it includes 700 mins, pay-as-you-go text/data
