Verizon will not replace a defective phone-newly purchased

I just signed up with Verizon after having ATT for years. I pre ordered the Samsung Note 4 online and received it 10/24/14. It has been freezing up since day 1 and many of the apps do not work properly, calls do not place properly etc. I called and spoke with tech support (more than one tech) and they said I need an SD card, that is what is wrong with the phone. I said that is not the case. Just because it doesnt have an SD card does not mean the phone would be having all of these issues from day 1. I spoke to numerous different people including the leadserhip team and they said that I have to take the phone into a verizon store (I live over an hour away from the closest one which is why I placed the order online) or I have to return the phone, wait for them tor receive it and credit me and then order a new one which means in the mean time I am out a phone which I cannot do. My wireless is my only phone and I have a 3 month old son so I cannot be without a phone. I asked if they could send the new one and then if they don't receive the old one within 2 weeks  they can charge me as I planned to send it back as soon as I got the new one. They refused and said the only way they could do that is if their tech team decided the phone was defective itself and they did not. They refused to send a new one and I just don't understand why they are being so difficult. I am a new customer, I spent my savings on this phone and I don't think it's too much to ask to have a phone that works properly. I am incredibly frustrated and if I can I am just going to turn on my old phone with ATT, return this one and buy the phone with ATT. I am so dissapointed.

And this is why you don't preorder phones or buy them when they first come out

This is the first time I've ever done it. U hope the phone is just defective not the entire collection but either way they aren't helping me out.

Definitely understandable, I would just not do it again. Fingers crossed they will get a software update out soon

Yeah definitely. I've learned my lesson. I had the same phone for almost 4 years so of course the new shiny one would appeal to me.

I'm in the same boat really, I want the Note 4 but after horror stores of the Note 3 will give it until at least December
