Any news? There is a serious lack of everything without this update. This phone is optimized for this update out of the box and samsung and microsoft both say it is at verizon waiting to be pushed out. What is the hold up?

Will we even be told if we will get the update? If so, how do we find out? I was told the phone would get the update by the salesrep, but so far nothing. I have a new phone that within 1 month has become outdated, and no one will tell us even where to look for information. So far this post is the closest I have come. Samsung ATIV SE was not a free phone. So I don't understand if it is left out of the update process. They are already talking about an update to the 8.1 we have yet to see. Is the answer No? The link provided above hasn't been update since January. I am boggled.

W-O-W I hope everyone who reads this hits my inbox. Over the last year I have had 9 that's right nine different devices through the mighty Verizon wireless. One refurbished like new boat anchor after another. It all started with my Razor HD that I loved for a multitude of reasons. Verizon however by changing whatever update from the manufacturer to suite their needs like the added pictures and hidden games to eat up your data with bloat ware all at the expense of "we the consumer". Or how many of us had unlimited data that is until we upgraded our devices and until we received our first bill realized that we were then were getting charged. I can go on and on and on forever at this point,but I will get back on track. Motorola expressed to me in writing that had Verizon not tampered with their device nor the update it would work exactly how it was designed. After it was all said and done. I had 4 Razer HD devices. Finally I had had enough. They tell you that the policy is to give you the exact same device ' like new' this is not true. you have the option to receive a device of the same value and I don't know about anyone else out there but I want what I paid for. So all that being said I was sent a HTC 1 with a case. Sounds great right? Not even close. I get the device after fighting for two days wit fed ex to get it. Low and behold the microphone in the device does not work and they will not honor a replacement at any location. Now I am without a phone for several more days. I am as you are all aware furious at this point! I finally have a Samsung s4 sent to me it has some sort of twitch from the moment I power it up and start using it. Long and short of it I have 3 more of those devices and I am told that I just need to upgrade. I am also told that the only devices you can get brand new as a replacement is the I Phone and Windows Phone. They talked up the windows 8 Samsung Ativ se to me and I said fine. As soon as it is available send it to me because after becoming accustom to a larger screen etc it was the only logical way to go. I have had this device for 4 months. If it did half the stuff they have promoted on television like swype or cortana or maybe use at least half of the apps android offers on EVERY DEVICE it would be great. Frankly it flat out sucks until the update that Samsung has already released and Verizon is making everyone wait for. Nokia is releasing it At&t had released it. It was dubbed the flagship blah blah blah. I have threated a class action law suite. Well who's with me? Who is sick and tired of being bullied by this company? I haven't gotten a thing free and have been with this company for over 6 years and now they want to rape everyone for data that cost them next to nothing. They keep messing with it to make a few more billion. We the consumers are paying the price by being sold knowingly faulty or updated to make sure it will fail so "we the consumer" will upgrade spending our hard earned money and get locked into a new contract. These are gorilla tactics. We are getting screwed on a global level. When the numbers add up and we can all get our just deserve in the way of reward. How is it again at this very moment they are selling the very same device I own now Samsung ATIV SE that is updated? I have had this device from day one and I still do not have the update. This utterly unacceptable and I know that there have to be millions around the globe that feel just as I do. I have lost time money oppurtunities and without question any minute remnants of patience I had left. Mr. Shawn

To Verizon Wireless:
Please help us. If it isn't apparent, your customers are becoming increasingly upset that we haven't been even remotely engaged with any information about the Windows 8.1 update (soon to be 8.1 update 1). Many people, like my wife and I (yes, we each have one), bought this phone on good faith when one of your sales staff told us that the phone(s) would receive the 8.1 update as soon as it was officially released. If I recall correctly, it was something to the effect that the phone shipped with Windows 8 to get the product in the hands of the consumer but that 8.1 was already tested and ready for "immediate" release. This approach would apparently get 8.1 out way faster because it was quicker to push the update over the air than it would be to wait until the official release date and then ship with 8.1 from the factory. Reading the boards, I have a pretty strong feeling that I'm not the only one who got this information for more than one model of handset. To make matters worse, when asked for information you try to placate the masses with an update link (go ahead, click Pamela's response to DeeCT) that doesn't even apply to the specific piece of hardware. If you're going to string us along at least please don't do it with the Samsung Odyssey... why not go all in and link it to the Galaxy S5 or a Blackberry or something? Otherwise, you could simply admit that you told us what we wanted to hear until you got us to to sign. This is the same move that Buffalo Bill pulls in "The Silence of the Lambs" when he tricks the girl into the back of his van. The best part is that everyone else saw it coming: "Probably not a good idea... this sounds shady... his arm isn't broken... why are you getting in the van? Idiot!" Unfortunately, I'm a loyal, long-time customer with few previous issues and took you at your word. I should have done more research into Verizon's reputation for timely updates and general concern for existing customers before I pulled the trigger. Well played. I get to put the lotion on my skin for the next 2 years. Well played.
I apologize for my frustration and bitterness, but I am tired of getting punched square in the groin every time my wife sees the Windows 8.1 "Siri vs. Cortana" commercial, as she reminds me how I convinced her against the iPhone.
That being said, on a positive note, my main gripe isn't with the phone. It's a good piece of hardware and works very well. I just didn't buy it for Windows 8.
Please just tell something... anything. If the phone wasn't successful enough to merit the update just tell us. If it's going to take more time then give us a better estimate than "we have no info". I understand that you have no obligation to provide the update and that the product shipped in working order with the "advertised" operating system, but you should understand that when your sales staff promises an immediate service and you fail to address your customers' concerns... you risk losing those customers.
So, throw me a bone. I just want to know if I get to hear about it during every commercial break for the next two years. Especially when the iPhone 6 comes out. That will be fun... I'm looking forward to that.

I too would like to know when the windows 8.1 upgrade will be available. I purchased a Samsung ATIV SE phone back in April with the understanding of your customer service reps that the win 8.1 upgrade would be available relatively 'soon'. If Verizon has no intention of making this upgrade available I will most certainly remember this when my contract expires. I DO NOT do business with companies that operate in bad faith.
If no upgrade is offered soon, or as I'm beginning to suspect never, what remedies will Verizon propose for customers stuck in a 2 year contract with a limited win 8.0 phone due to Verizon's failure to deliver as promised?

Verizon does not have to upgrade your device.
The phone functioned when purchased. Any updates are a bonus and not a given.
Read your customer agreement. Additionally complaining to the FCC will do no good. But some here will chime in with it is the bad carrier that is not doing their duty. Don't believe it.
If you get it you get it.
Another poster used a link to me earlier that said Verizon updated iphones. The post from 2011 clearly stated Apple does all updates so complaining to Verizon will do no good. All carriers are not obligated to push updates to your phone.
In this case look to your device maker and Microsoft.

Oh yes allow me to add one more thing. The nice Verizon representative at the store said to me you can download it on your computer and update it that way. Of course I can and void my warranty on my $600 device attached to a bs contract that is with a provider whom has gently shoved a chainsaw up my rectum for the last two years. That is exactly the kind of treatment I am looking forward to for the next 2. I don't fn think so!

Some corrections to your postings.
Verizon wireless does not touch the base coding of any update. They simply ask for certain apps to be placed on the device as does every carrier. You were lied to from Motorola. They are responsible not Verizon.
Verizon wireless as a retailer simply sells the devices, the warranty is from the phone maker. So Motorola and HTC and Samsung all generate the warranty and not Verizon.
Verizon as a courtesy not as a right to the consumer replaces devices as manufacturers warranty. They do not have to replace any devices. The warranty in the box clearly states you send your device back to the manufacturer yourself. So now you are mad at Verizon for assisting on a quick replacement. The warranty is for a like new device, not a brand new device.
And lastly, you cannot file a class action anything against Verizon per the US Supreme Court Decision. Only single right of action or arbitration.
It does not mean you cannot try to go after the device makers. On that...

As stated in the box. You are correct you can send it back to the manufacturer. However Verizon charges you for not returning the device immediately. As far as not being able to gather people together to go after a company that puts it to their customers. I have nothing but time and opportunity to do just that. Verizon dose a courtesy by giving me knowingly faulty equipment? It goes without question that this is against the law! They sent out the Razor HD update and ruined the device. Pushed it right out. Then another and that device never worked properly again. I would love to hear Verizon and Motorola has out who is in the wrong. What difference would it make? Both companies are making money off of the pain and anguish of their consumers. I have all the right in the world to start a blog and see just how many individuals have serious issues with the company. How about the droid dream malware you continually denied until there was no other choice but to admit defeat and say oops we messed up and tried to deny it. This just one example in the "plausible deniability" that Verizon is so used to exercising. In the box is says you will be issued a device of equal value to your device. Not some junk that "we Verizon" knows is faulty. Sorry I got a bit off topic. I will be happy to see what the law department has to say. I will also see how many Verizon customers are more than just a little upset with the way they have been treated. All things lost piece of mind included. We The People have rights and if we choose to exercise those rights. Its our constitutional right as well as our prerogative.

The problem with faulty devices is the manufacturers set the warranty terms and conditions. (Not talking about updates)
If you purchased it from Walmarts or Best Buy you would have no choice but to use the device makers return and warranty department.
However many people forget that Verizon acts as a retailer of devices and accessories and they all come with the standard warranty provisions.
Because Verizon and other cellular providers choose to swap out the devices for you does not actually negate the manufacturers warranty on the items.
In many warranties I have noticed they have a disclaimer of replace or repair and some even say it will be with a New or Like new replacement. That does give those companies a load of leeway.
Now in regards to class actions against Verizon the US Supreme Court has ruled them out because Verizon has a arbitration clause in their customer agreements.
I am not sure if the cell phone maker has such protections. You would have to ask your attorney or legal department or look at the terms for the company that made your device.
Unfortunately Verizon's use of the manufacturers warranty is what governs their actions. You may have better luck dealing directly with the device maker. Even if you have to wait longer to get the phone back.
See if they (device maker) will replace with a brand new phone.

Since I had purchased the phone several months ago I am stuck with the device. I am at a loss in any other means other than litigation because I feel that I have been lied to for the last year plus. I am going to contact Samsung right now and see exactly what they are going to give me in writing before I proceed any further.

I believe its a year on the warranty. I would insist that Samsung replace it with new. They may do it or even a comparable device would be better for you.
That would be good customer service.
I know Verizon will only switch out with used devices. I hate that since the issues your old phone had may pale in comparison to the certified like new replacement.

I'm guessing that those phones for sale down the street from you had a Samsung firmware update, THEN the Windows 8.1 update. That's interesting information about working ATIV SEs with Windows 8.1 being spotted for sale. How hard have you pushed Samsung to see if they have a firmware update? I'm not as badly stuck as you are because I will return my Samsung ATIV SE this Saturday if the update isn't available. I will still be within the 14 return period. It is tempting to go back to my basic (non-smart) phone with no contract and be done with it.

I'm tracking. I honestly didn't expect any information about the update... quite the contrary, I would have been amazed if Verizon actually provided any relevant information for you to pass along. I would simply suggest that your company uses questionable practices. The long-short of this is that I would never have purchased the phone if your sales person had told me that he had no information about the Windows 8.1 update. To be blunt, I believe that he knew this and intentionally mislead me to sell the handset(s) as part of a directed marketing tactic to push this particular product. Your company could easily calculate that the return period would expire well before the vast majority of customers would complain. At the end of the day, you still have a 2-year contract that will likely outlast the average customer's attention span and memory. By that time they will either be too lazy to change carriers or you'll try to entice them with "loyalty discounts" or some other ploy to be their best buddy until they sign again. If this isn't the case, they there must be some sort of commission or entitlement program that would entice salespeople to "go rogue" to sell handsets regardless of what they had to promise (but let's be honest, if this were the case Verizon would better benefit from acknowledging and fixing the problem as opposed to ignoring it). That's it. Do with it what you will. I don't want apologies. That being said, I would like an explanation but realize that this will never happen. Who really cares if a hand full of customers are unhappy when millions of others either are oblivious, don't particularly care, or are simply too lazy to complain about being screwed and just take it?
