iPhone Clean ENS, but iCloud Activation Lock?

Please somebody help me. I purchased an iPhone 5 with a clean ENS, however the iCloud Activation Lock is in effect? Should I return the phone or being that it is a clean ENS is there another way around it, because I know that while that lock is set I cannot use my new phone at all

I am going to assume this was bought second hand? Not from verizon but from an individual or online purchase?

Someone has locked the device, it cannot be used. The previous owner locked it due to loss or theft. They did not report the device to their carrier so naturally the id is clean.

If this was a one on one sale get the previous owner to remove the activation lock, if they refuse get your money back.

I cannot caution people enough on these so called purchases.
