How can I get a lost device replaced?

I lost my iPhone today, I think that it dropped out of my pocket on my way to school and it was updating so Find My iPhone couldn't help me. This May will make the 1st year of having this phone. I was wondering how my mother and I should go about having my phone replaced and contract renewed with little/no fee.
