Really sorry you're having issues with your Tour. One of the members here (can't remember which one) has a fix action for track balls that don't work properly out of the box just wait for them to reply. As far as your battery issues, what is the problem? Can you be more specific? How long does it last? What apps do you have on your phone? The Tour is a very good handset and I think if we can work these two issues for you, you'll really like it. Don't waste your upgrade, let try and fix it first. Please answer the questions and report back.
