Droid I2 won't hold charge, battery drains

After having spent the last couple hours reading the HUNDREDS of posts with people having the SAME problem as I am...I'm not sure what to do with this phone! This is my 2nd incredible 2. The same problem (battery draining, spotty and slow recharging) occurred in September (I had the phone 1 day before a year). They said it was the phone and it was under warranty and sent me a new phone next day. They didn't say it was "refurbished" but I'm assuming it was. Anyhow, I've had it since 9/2/12 and, AGAIN, having the exact same issue the last week or so! It was at 29% at 10:00 this morning. After playing with the phone, I finally found a position it would charge in and, now some 6+ hours later without touching it, it is at 62%. What is "funny" is there was no warning...one day it was fine, the next it wasn't! I've read it's probably the charging port. I've also read this issue as far back as 2011. Soooo, why have they not done anything to fix the issue? Obviously they knew about it. SO, what...I go to the Verizon store and, maybe, they send out a new one? So that one can quit working in 3 months too? I have another 9 months until I can upgrade...this is going to get awfully annoying!
I've done everything I read to attempt to fix it (ending with the factory reset) and nothing has worked. I thought at first maybe it was the battery (same battery as the last incredible 2) but, after reading all these posts, looks like it's a defect with the phone.
Anyone had any recent luck with any method to fix it? I don't have a home phone...I pay close to $100/month for this phone...it's ridiculous to have to go without a phone for something that isn't the user's fault. I have never even DROPPED this phone! I have taken excellent care of it so I sure hope they don't try to say it's something I did!
Off I go to the Verizon store...will post a solution if I get one!

i have been having the same problem. a friend of mine gave me the phone and it has been doing it ever since.the other night i had it on the charger all night and it was dead when i woke up took it and put it on my car charger and it turned on and said it was 67% charged. I am really getting tired of this phone it makes no sense what so ever

Since hundreds of people are going through a similar problem and VerizonWirless (or Verizon the company itself) seems to be turning a blind eye to the situation.... rather than complain on a forum where no one is listening, has anyone tried contacting a lawyer. I think if there is enough interest, and if people feel they have been unfairly treated, it could be something to look into.
