How to return yet another DINC?

Hey guys hoping to get a little clarification on a DInc return
I first started w/ verizon in the beginning of Oct. Sent me a Dinc w/ the notorious bad speaker issue. They sent me a brand new replacement and I received a text message that I had to activate it BY Dec. 5th 2010. I got lazy and didn't activate it until December 4th (sat in box for awhile). After activation I noticed the problem still wasn't cleared up.
So now I sit on Dec. 5 w/ two phones. I switched back to the original phone because the speaker was a tad bit better, but still very "muffled". I'm going to send back the replacement (I believe I have 10 days after activation).
My question is, after activation of the replacement phone do I get another 30 day period for replacement w/ a Brand new unit, or do I have to start receiving recertified phones?
PS. I noticed after activation of the replacement phone my new every two date was pushed back 2 months, which leads me to believe I have another window for return

Honestly I suspect the 2nd unit was a refurb. New devices are only used for replacements for 30 days after the initial activation, unless you have been holding onto the 2nd phone for a long while.So when you do attempt to do another replacement, it will be a refurb.
Not knowing how long, the 2nd phone sat around, I bet when you get your new invoice you will have been charged full price for the second phone.

The replacement was ordered within the 30 day period and was indeed brand new (110% sure). I was told by a verizon rep that I had 10 days to return after activation so I presume I won't be charged
The phone sat around for about a month and a half, but again I activated BEFORE the Dec 5th deadline

I can all but guarantee you will be hit with a charge for that second phone. Do you have what the rep stated in writing??? It will be removed once a phone is returned and sent through the system.
Aside for that, the next phone will NOT be new.
Although I ended up canceling a replacement phone when I corrected an issue with my phone., I had ten days to get everything completed. Activation and return process began.
