Nicks and scratches out of the box?

Bought the Motorola on Saturday but realized that there were three blemishes on different areas of the case. Just tried to exchange it, but they were giving me crap about how they couldn't exchange it unless there was something technically wrong with the phone.
To make things worse, the rep was rubbing his disgusting, greasy fingers (and nails) over the phone, trying to find the blemishes, which was apparently a complete waste of time since he was clearly blind and did nothing but potentially scratch the phone up even more.
They said the only way to exchange it is to return it, but I would be charged a nonsensical restocking fee. I'm going to call in and see if I can get a $35 credit in the event I go that route, but does anyone have a similar story and was able to get their blemished phone exchanged?

My recommendation is that you do what I do when you get a bad customer service rep: wait a period of time and see a different customer service rep. If the item was damaged out of the box, and you can easily point out the blemished when shown side-by-side with another phone, then it shouldn't be an issue. Over the phone, this is usually as easy as calling again. For an in store rep, just go to a different store, or go during a different shift. Just put teh store a good distance form the first one. Say that it was inconvenient to drive back to the other one.

That makes no sense whatsoever. They should be able to definitly go and replace it for you, seeing as how you did not want a messed up Droid.
