I have a HTC droid and I had it for around 3 years, but lately is not work good, and I'm thinking on buy an other one, but I'm not sure if I have to pay for the activation kit as well, because my acount is active. I'm so confused

Depending on the plan you are on, doing an Edge contract might be cheaper for you in the long run. With qualifying plans I've seen an average of $200 savings over the course of 2 years.
If you do a 2-year contract, then yes, you will be the upgrade fee of $40, plus the cost of the phone.

This activation kit you speak of, maybe you are talking about an upgrade fee for $40 on a 2 year contract. Edge agreements have no upgrade fee. Activation fees are what is charged when you first start service with a new line on contract plans.
