yes. you can't purchase and activate it without the $30 data plan. and really, you wouldn't want to. without plenty of data, it is just a cool looking phone that you couldn't do much with.

Just also to add doesn't where you purchase the device either.You'll still be prompted of that data plan. Believe it or not some people just want the phone & don't want to use the internet at all. Which is indeed odd.
