IPhone upgrade

I have a iphone 4s 2 year contract. I have 1 year to go to get a new upgrade. My husband's 'non-smart' phone is eligible for a new phone. Can I transfer his non-smart phone upgrade to my phone number to get the iphone5? Can he still keep his phone? If I can do this, can I sell my iphone4s even though I have another year in my contract?

Yes, yes, yes just note that if you have unlimited data that once you upgrade it will go away Vzw does not offer unlimited data anymore you will have to pay for data
