After switching from a M8 to a M9 I am now getting a pop up when I'm on a call saying "mobile data is not available when on this call."
And sure enough no mobile data. Never had this problem before. I also switched to the Verizon plan Xlarge
Surfus, thanks for letting us know about this issue and I do enjoy going on the internet when I'm on a call as well. Let's look into this deeper and get this resolved. Has this feature ever worked on the HTC M9? Are you connected to WiFi when you are connected on a call?

Like I mentioned on my question was I never seen thus message with my M8 and only got the pop up message after upgrading to the M9.

when I do not have Wi-Fi and I make a call and try to open a app that uses data
I asked Verizon about it and they told me I should be able to make calls and use mobile app with data.
So I Wondering if it is a setting I need to change with the M9
The radio configuration of the phone can't handle data and voice where the old phone had a different configuration. The M9 might need Advanced Calling enabled if capable to have the calls go over the VoLTE instead of the 1xRTT network.
We do appreciate the additional details. I have to agree, with Ann154, I would double check your Advanced Calling feature to ensure it is enabled. This is the feature that allows you to utilize data while on a call. On the M9 you may check it by: Settings->Advanced Calling. You will want to make sure it is activated.

OK Iowa's looking into that but had some concerns.
According to the FAQ I will lose my paid extra future
Caller name ID
I'm in the service business and really need to know who is calling me and or missed calls
Also I need to be able to use data when I'm on a call so I can look up parts, customer info and Calendar information online at the same time I'm on a call with customers like I was able to do with my M8.
I also want to know if google voice will still intercept my voice mail.
And last but not least I'm in a area that within feet service switched from 4g to 3g or even 1x. Will this switch cause me to drop calls.
